Lexogen Award – Terms and Conditions

Please read the following terms and conditions (collectively: “terms”) carefully. By submitting your entry, you agree to these terms for yourself and on behalf of your Institution/Company. “You” and “your” shall refer to you personally or your Institution/Company, as applicable. “We”, “Us” or “Our” includes Lexogen and/or its officers, employees, directors, agents, and affiliates.

1. Submit an Application, including the contact information, title, abstract, materials/methods, answers on the additional questions as outlined in the description of the Lexogen Research Award Program. Submission may be done via Application form in the Award web page https://www.lexogen.com/award-2017-1, or via e-mail to info@lexogen.com. To have your submission considered, it must be in English language, contain your institutional e-mail account and be complete.
2. Only one Application per applicant is allowed. However, multiple submissions, from different applicants, may be submitted by the same research group.
3. The project is considered relevant if it includes the RNA with the following qualities: RIN is less than 5 or RNA is extracted from FFPE samples. If the RIN is <=2 then DV200 value should also be reported (% of fragments >200nt in the RNA sample).
4. Applications can be submitted from 12:01 AM CEST 2 May 2017 until 11:59 PM CEST 30 June 2017.
5. Applications will be preselected by Lexogen team members and the final winners’ selection will be done by external referees.
6. Applications will be judged at the sole discretion of the referees based on how well the Topic of this Research Award is described and the utilization of the QuantSeq product in the process described.
7. Three prizes will be awarded based on the decision of the referees. These decisions are final.
8. The prize winners are to be announced on 1 August 2017 via Lexogen web page and the winners will be contacted by Lexogen via e-mail or telephone.
9. The prizes are:
   A QuantSeq 3’ mRNA-Seq Library Prep kit for Illumina, one 75 SR run on an Illumina NextSeq® * and data analysis. The run and data analysis will be done at Lexogen’s facility.
   Additional prizes may be awarded if the winning Applications list a recommender. The recommender will be eligible for the additional prize, which is an Amazon voucher with the value of USD 200.

10. Prize winners agree to be available for reasonable promotional activities for the remainder of the calendar year of 2017 and 2018. Promotional activities may include Website/Newsletter story features.
11. Lexogen employees and contractors (and their immediate families), and members of the referees’ research teams (as determined by Lexogen) are not eligible to participate in this offer.
12. You agree to obtain all authorizations and permissions from your Institution/Company or others that are required to allow you to make this submission and have your name and institution name used for all purposes, including marketing, by Lexogen or its affiliates without any compensation and with or without attribution, regardless of whether your entry wins the contest. You also agree personally to all the authorizations and permissions required by these terms and conditions.
13. You agree that the use of your submission by Lexogen does not violate any rule, policy, copyright, trademark, patent, or procedures of your Institution/Company or that of any other person. You agree that all parts of your submission, including any attachments, become the sole property of Lexogen.
14. You acknowledge and agree that any submission made hereunder is not being made in exchange for any promise of business to Lexogen.
15. You agree that Lexogen may contact you for purposes of marketing its products and services.
16. The judges will have full, sole, and absolute discretion regarding which submissions are selected as the winners of this competition.
17. Lexogen reserves the right to discontinue or modify this program at any time for any reason. In such event, Lexogen will post a notice on our website and inform all already submitted entrants via e-mail. In the event of discontinuance, Lexogen will have no liability to you, your employees, and agents or team members for such cancellation or modification.
18. Lexogen may refuse to consider a submission if Lexogen determines in its sole discretion that awarding the prize to the entrant would likely result in a violation of an applicable law, rule, or policy, including, but not limited to, if contrary to the law where you reside.
19. The odds of winning this contest will depend, in part, on how many contestants enter. However, we cannot predict with specificity how many contestants will participate.
20. Each applicant is responsible for all of your own costs, and the costs of your employees and agents, incurred or that may be incurred in connection with this offer, including, without limitation, any tax liability (including any income tax associated with the value of the award), and any costs associated with entering into and participating in this offer.
21. IN NO EVENT SHALL LEXOGEN, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER ARISING UNDER OR AS A RESULT OF ENTRANCE IN OR PARTICIPATION IN THE OFFER, WHETHER BASED ON WARRANTY, CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT LEXOGEN IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.
22. LEXOGEN’S TOTAL AND CUMULATIVE LIABILITY ARISING UNDER OR IN CONNECTION WITH THE OFFER SHALL IN NO EVENT EXCEED THE TOTAL VALUE OF THE AWARDS ELIGIBLE UNDER THE OFFER.
23. Any and all actions, claims, disputes, or controversies relating to this offer shall be governed by the laws of Austria, without regard to its conflict-of-laws principles. By submitting your entry, you expressly consent to the exclusive forum, jurisdiction, and venue of the District Court (Bezirksgericht) of Vienna, Austria in such actions, claims, disputes, or controversies.
